Read This First

These aren’t just legal formalities. Read them. By booking with SaharaTrek, you agree to these terms. No exceptions.


What SaharaTrek Does (And Doesn’t Do)

What We Do:

  • Organize private tours through Morocco
  • Vet and contract with hotels, drivers, guides, and other service providers
  • Negotiate rates and coordinate your itinerary
  • Provide information and support throughout your journey
  • Act as your advocate if problems arise

What We Don’t Do:

  • Own hotels, vehicles, restaurants, or tour sites
  • Employ the drivers, guides, or hotel staff you’ll encounter
  • Control weather, political situations, or acts of God
  • Operate any transportation or accommodations directly
  • Guarantee that everything will go exactly as planned

The Reality: We’re the organizer, not the operator. We work with a vetted network of independent suppliers who provide the actual services. They’re responsible for their services. We’re responsible for putting together a great tour and helping when things go sideways.


Information We Provide

Here’s the deal:

  • We provide detailed itineraries and information about your tour
  • We answer questions to the best of our ability
  • But we don’t know everything, and we can’t tell you everything

Your Responsibility: If you have questions we haven’t addressed—about health requirements, visa regulations, accessibility, dietary restrictions, or anything else—you need to ask. Don’t assume. Ask.

We’re happy to help. But we can’t answer questions you don’t ask us.


Pricing and Payment

How It Works:

  • All prices quoted in U.S. dollars
  • Based on two people sharing a room (unless otherwise stated)
  • Subject to change until you book

Payment Schedule:

  • 50% deposit when you book (confirms your reservation)
  • 50% balance due 30 days before departure
  • We accept major credit cards, wire transfers, checks

What’s Included:

  • Accommodations as specified
  • Meals as indicated in your itinerary (B=Breakfast, L=Lunch, D=Dinner)
  • Private transportation during the tour
  • Entrance fees listed as included
  • Private guides as specified
  • Taxes

What’s NOT Included:

  • International flights to/from Morocco
  • Travel insurance (GET IT – see below)
  • Visa fees and passport costs
  • Tips for guides and drivers
  • Meals not specified in itinerary
  • Alcoholic beverages
  • Personal expenses (laundry, phone calls, souvenirs)
  • Optional activities not in your itinerary
  • Medical expenses
  • Anything not specifically listed as included

Bottom Line: If it’s not explicitly listed as included, assume it’s not.


Cancellations and Refunds

If You Cancel:

  • 30+ days before departure: 95% refund (we keep 5% administrative fee)
  • 29 days or less before departure: No refund (you forfeit 100%)

The Fine Print:

  • All cancellations must be in writing (email counts)
  • Effective date is when we receive your written notice
  • Changing dates or tours within 30 days = cancellation + rebooking
  • Arriving late or leaving early = no refund for unused portions
  • No exceptions. None.

If We Cancel:

  • Before departure: Full refund OR credit toward future tour
  • During the tour: Prorated refund for days not completed
  • Exception: If cancellation due to war, natural disaster, pandemic, or other force majeure event making the tour infeasible, we’ll provide refund/credit but aren’t responsible for your other expenses (flights, hotels you booked separately, etc.)

If You Leave Mid-Tour:

  • Your choice to leave = no refund
  • You’re on your own once you depart
  • We have no responsibility for what happens after you leave

Travel Insurance: GET IT

Let’s be clear:

Travel insurance isn’t optional in our minds. It’s essential. Critical. Non-negotiable if you have any sense.

Why:

  • Medical emergencies abroad are expensive
  • Evacuation from the Sahara costs thousands
  • Trip cancellation happens (illness, family emergencies, global pandemics)
  • Lost luggage ruins trips
  • Our cancellation policy is strict (see above)

What We Recommend: Comprehensive travel insurance covering:

  • Trip cancellation/interruption
  • Medical expenses and evacuation
  • Lost/delayed baggage
  • Travel delays
  • Emergency assistance

Our Position: We strongly recommend purchasing comprehensive travel insurance. We’ll provide information about options when you book. If you choose not to get insurance and something goes wrong, that’s on you.

Consider yourself warned.


Your Responsibilities

Documents: You need:

  • Valid passport (6+ months validity recommended)
  • Required visas (Morocco visa requirements vary by nationality)
  • Vaccination certificates if required
  • Travel insurance documentation

Research: Check current travel advisories:

  • U.S. State Department: https://travel.state.gov
  • CDC: https://www.cdc.gov
  • Your own country’s equivalent

If you show up without proper documents, you can’t travel. We don’t refund for your failure to prepare.

Health and Fitness:

  • Morocco involves walking, stairs, heat, and physical activity
  • Some sites aren’t wheelchair accessible
  • You must disclose any medical conditions or limitations when booking
  • We’ll accommodate when possible, but can’t guarantee accessibility everywhere
  • Consult your doctor about travel to Morocco

You certify when booking that:

  • You’re physically and mentally capable of participating
  • You’ve disclosed any conditions requiring special accommodation
  • You won’t endanger yourself or others

We reserve the right to remove anyone from a tour who:

  • Endangers themselves or others
  • Disrupts the tour experience
  • Fails to disclose conditions requiring accommodation we can’t provide

Things Beyond Our Control

We’re not responsible for problems caused by:

  • Weather, natural disasters, acts of God
  • Political unrest, terrorism, war
  • Strikes, labor disputes
  • Government actions, border closures, and new regulations
  • Pandemics, epidemics, quarantines
  • Airline delays, cancellations, or failures
  • Theft, crime, accidents
  • Supplier failures (hotel closes, driver quits, etc.)

If something beyond our control disrupts your tour:

  • We’ll do our best to provide alternatives
  • We’re not liable for expenses you incur
  • We’re not refunding for things we didn’t cause
  • We’ll help, but can’t perform miracles

Reality check: Morocco is a developing country. Infrastructure isn’t always perfect. Things sometimes go wrong. Flexibility and good humor are essential.


Itinerary Changes

We reserve the right to change:

  • Accommodations (of equal or better quality)
  • Specific guides or drivers
  • Routes or timing
  • Activities if unavailable

We’ll notify you of significant changes when possible.

Why changes happen:

  • Road closures
  • Weather
  • Supplier failures
  • Safety concerns
  • Better alternatives available

We make changes for your comfort, safety, or to improve your experience. We don’t make them capriciously.


Photography and Marketing

Our Pictures: We may photograph or video during tours for promotional use. By booking, you consent to appearing in these materials without compensation.

Don’t want to be photographed? Tell us in writing before departure.

Your Pictures: If you provide photos or videos to us (via email, social media, feedback forms, etc.), we may use them for:

  • Marketing materials
  • Website and social media
  • Promotional purposes
  • Editorial content

You retain copyright. We get a license to use.

If you don’t want us to use your images, don’t send them to us.


Assumption of Risk

By booking, you acknowledge:

Travel to Morocco involves risks:

  • Remote locations with limited medical facilities
  • Activities with inherent danger
  • Different safety standards from those in the United States/Europe
  • Potential for illness, injury, or death
  • Political instability possibilities
  • Infectious diseases
  • Traffic accidents (Moroccan driving is… spirited)
  • Weather extremes

You’re choosing to accept these risks.

Medical facilities in Morocco vary:

  • Major cities have decent hospitals
  • Rural areas have limited facilities
  • Standards differ from those in Western countries
  • Evacuation may be necessary for serious conditions

You’re responsible for:

  • Medical insurance covering international travel
  • Evacuation insurance
  • All medical costs incurred
  • Getting yourself appropriate insurance (see above: GET INSURANCE)

What We’re Not Liable For

The Released Parties (SaharaTrek, our affiliates, employees, agents, assigns, etc.) are not liable for:

  • Supplier failures or negligence
  • Injury, illness, or death from any cause
  • Lost, stolen, or damaged property
  • Delays or cancellations
  • Changes in itinerary
  • Failure of transportation
  • Acts or omissions of third parties
  • Your own negligence or assumption of risk
  • Anything beyond our reasonable control

You waive any claims against us arising from these issues.

Baggage and personal items are your responsibility at all times.


Optional Activities

If you choose activities not arranged by us:

  • You’re on your own
  • We have zero responsibility
  • We have zero liability
  • You release us from any claims arising from these activities

Examples: Renting a scooter. Going on a random camel trek. Hiring a guide independently. Wandering off alone.

Your choice. Your risk. Not our problem.


Legal Stuff

Disputes:

  • Governed by Florida law
  • Settled through binding arbitration via the Better Business Bureau in Florida
  • No class actions – you can only bring individual claims
  • No jury trials – both parties waive jury trial rights

If any provision is found invalid: The rest of this agreement remains in effect.

Minors: Anyone under 18 must be accompanied by a parent/guardian over 21 in the same room.


Medical Authorization

If you become incapacitated during the tour:

  • You authorize necessary medical treatment
  • We’ll try to contact your emergency contact
  • If we can’t reach them, doctors will treat as needed
  • You’re responsible for all medical costs
  • This is why you need insurance (seriously, get insurance)

The Bottom Line

You’re hiring us to organize a private tour through Morocco using our network of vetted suppliers. We’ll do everything reasonably possible to ensure you have an amazing experience. But we’re not magicians. Things sometimes go wrong. When they do, we’ll help. But we’re not liable for circumstances beyond our control or for suppliers’ actions.

Get travel insurance. Prepare properly. Ask questions. Be flexible. Have realistic expectations. Morocco is incredible, but it’s not Disneyland.

By booking, you accept these terms. All of them. Non-negotiable.
